Pathak was among seven AAP Rajya Sabha MPs who resigned, alleging the party had deviated from its core principles. Their merger with the BJP has reduced AAP's strength in the Upper House.

Punjab Police have filed two FIRs under sections for non-bailable offences against Rajya Sabha MP Sandeep Pathak. Both FIRs were filed in different districts of Punjab.
