The Allahabad High Court has held that the convenience of the wife, the education of a minor child and the pendency of connected maintenance proceedings cannot, by themselves, justify transfer of matrimonial proceedings under Section 24 of the Code of Civil Procedure. The Court observed that transfer is a discretionary remedy to be exercised only where refusal would result in genuine hardship or failure of justice, and cautioned that the provision cannot be invoked merely to secure a more convenient forum.
